In the name of God I William Twyman of Barren County, Kentucky now living and desiring to dispose of my estate in an equitable manner amongst my six children, according to their condition do make and ordain the following to be my last will and testament in manner and form following. That is to say
1st My will is that my daughter Elizabeth Craig have the land, negroes and other property that I have heretofore given to her. Viz, three hundred and three acres of land as per my deed of conveyance to Clemont Craig, her husband one horse bridle and bridle and saddle,(Clerk Boo Boo) one cow and calf one beef steer, six ewes, one sow, one negro girl Prudence, one bedstead and furniture, one bureau, cooking vessels, table furniture, six chairs and two pewter basins, all of which I estimate as being worth $1,998.50.
2nd my will is that my daughter Lucy T. Yancey have land, negro and other property that I have heretofore given her Viz, three hundred and five acres of land as per my deed of conveyance to her husband Joel Yancey. One horse bridle and saddle, one cow and calf, one beef steer, six yews, three sows, one negro girl Mary, one bedstead bed and furniture, six chairs and two pewter basins. All of which I estimate as being worth $2,002.00.
3rd My will is that my son William Twyman have the land, negro and other property that I have heretofore given to him. Viz Three hundred and sixty acres of land as per my deed of conveyance to Lewis Slinker for William one horse bridle and saddle and George a negro boy which is subject to a reserve hereinafter made all of which I estimate as being worth $1,625.00.
4th My will is that my son Garland Twyman have my negro boy Warren, my Negro girl Loisa and my Negro boy Tom subject to a reserve hereinafter made in addition to a horse bridle and saddle that I have heretofore given. All of which I estimate as being worth $1,925.00.
5th My will is that my son John Twyman have my negro boy Alexander, my negro woman Temperance and child, my negro Frank and my negro boy Eli subject to a reserve hereinafter made and one horse bridle and saddle that I have heretofore given to him. All of which I estimate as being worth $1,125.00 (the ink is badly smeared on the dollar amount and the amount I have typed is subject to change)
6th I give to my daughter Emily Twyman the Ell room of my house during her life. She is to have and enjoy and use it in such manner as she may choose. She shall have the free use of and way to the Spring to have water brought her She shall have privilege to have wood cut from the tract of land I live on. She shall be free in her privileges to receive the company of her friends and entertain them in her room free from any restraint, by any owner of the main part of the house. I also give to Emily my two negro men Joshua and Henry during her life also my negro girl Mary Ann, to wait upon her during her life and in case that either or all of said negroes shall die before Emily dies, the place or places of such as die shall be supplied from my family of negroes, not herein specifically devised. The bedclothes that Emily has made are hers. I give her the bedstead, bed and furniture she lies on. I also give her another common bedstead and bed and furniture, the bureau in my room, the walnut fall leaf table that is in her room, six common chairs, one common set cups and saucers on set plates, two dishes, one set knives and forks, half a dozen common glass tumblers, one sugar bowl, one oven, one pot and one skillet of suitable size for her cooking, one set of Silver tea spoons, one set common table spoons. I will and direct that Emily have one hundred and fifty dollars out of the proceeds of my estate. I give Emily one cow and calf, and she shall have the privilege of keeping them at and on the plantation. If Emily shall at anytime become dissatisfied to live and remain in the room I here provide for her and shall choose to do, she may sell her life time right to the room and attendant privilege to wood and water and go any other of her friends with whom she can be best contented I give Emily two half gallon pewter basins.
7th I give to each of six children as a token of my love to them one of my silver table spoons that is engraved with the letters W. L. T..
8th It is my will that my sons have equal portions of my estate with my daughters Elizabeth and Lucy. Therefore direct that my sons William, Garland and John shall such property of my estate as can be agreed upon and allotted until their portions shall be equal to the portions of Elizabeth and Lucy. If it can be so done, I direct that said allotment shall be in such articles of property as Elizabeth and Lucy received.
9th I will and direct that my old servant Bob shall have the right to choose which of my children he will live with and shall go to and live with that one. When Bob shall have elected which of my children he shall live with it shall be the duty of my executors to give to the one of my children one hundred dollars as compensation for the care that is due to a faithful old servant.
10th I direct that my other negroes not specifically devised, shall be divided amongst my five children; Elizabeth, Lucy, William, Garland and John so as to make all equal according to valuation.
11th It is my will that if either of my sons William, Garland and John or my daughter Emily shall die without a child in lawful wedlock, that in that case the property herein given to either of them shall revert to their brothers and sisters to be equally divided amongst them or their heirs.
12th I give my family bible to William.
13th I wish that all my just debts to be paid out of the proceeds of my other personal estate and my funeral expenses to be paid. After that and one hundred and fifty dollars herein given to Emily and one hundred dollars provide for taking care of Bob and the specific devises herein made and expenses attending the executing this will I direct that any remaining sum shall be equally divided amongst my five children; Elizabeth, Lucy, William, Garland and John.
14th My will is that my children shall agree upon the price of my land and that one of them shall by agreement with the rest take it and pay to the others their equal portions in one, two and three years. But if they cannot agree, then it is my will that my land shall be sold on credit of one, two and three years to the highest bidder, reserving to Emily her rights under this instrument and the proceeds equally divided amongst my children Elizabeth, Lucy, William, Garland and John.
15th And lastly I do hereby appoint
my son William and my son-in-law Joel Yancey and my friend James G. Hardy
executors of this my last will and testament, who I direct to sell and convey my
land according to the tenor of the foregoing and if by any accident any one or
two of them shall fail to qualify as executor the one or more that does qualify
shall execute this instrument as fully as if all were to qualify. In testimony
whereof I have hereunto set my hand and affixed my seal this 13th day

I William Twyman Sr. of Barren County, KY do hereby make and publish this Codicil to be added to my last Well and Testament in manner following towit, whereas in my said will I give and bequeathed unto my daughter Emily who is afflicted, the Ell room of my house together with access to timber and water to have during her lifetime. I wish that part of my said will changed and for the said Ell room etc. to be soald possession given at the same time my lands is directed to be soald in my said will and __?__ thereof. I give to my said daughter Emily one hundred and fifty dollars to be paid to her by my executors over and above the balance I bequeathed to her in said will out of the proceeds of the lands when soald and lastly it is my will and desire that this present codicil be annexed to and made a part of my last will and testament aforesaid. In witness whereof I have hereunto set my hand & affixed my seal this 27th day of January in the year of our lord 1851. Acknowledged in presents of :

The foregoing writing purporting to be the last will and testament of William Twyman and the Codicil thereto attached were produced in court and the said will proven in due form of law by the oaths of J. G. Hardy, Presley N. Thomas, Joel Bradley and Stephen Ratliff witnesses thereto and the codicil was proven in due form of law by the oaths of said Thomas Bradley, and Ratliff subscribing witnesses thereto, whereupon the same was ordered to be the true last will and testament of said William Twyman decd.
