DEED OF FRANCIS TIMBERLAKE

Franklin County, North Carolina, 1789




This Indenture made the Twentieth of June Anno Domino One Thousand Seven Hundred and Eighty-seven. Between Elizha Stallings, of Franklin County, and State of North Carolina, of the one part, and Francis Timberlake, of the same place, of the other part.

WITNESSETH: that the said Elizha Stallings, for and in consideration of the sum of Fifty pounds Specie currency, to him in hand paid by the said Francis Timberlake, the receipt whereof he doth acknowledge, and himself fully satisfied and paid both given, granted, Bargained, sold, Release and convey and confirm, and by the presents do freely give, grant, sell, release, convey and confirm unto him, the said Francis Timberlake, his heirs, executors and assigns forever, a tract or parcel of land lying in the county aforesaid, on Buffalo Creek, adjoining the lands of said Stallings and Elias Stallings, of Joseph Sewell and Elijah Derby, being part of that tract of land wherein the said Stallings now lives, and sold to the said Timberlake, containing by estimation One Hundred acres of land, more or less.
TO HAVE AND TO HOLD the said One Hundred acres of land above granted and sold to him, the said Francis Timberlake, his heirs, executors, administrator and assigns forever, and the said Elizha Stallings for himself, his heirs, executors and administrators, doth hereby covenant and agree to and with the said Francis Timberlake, his heirs, executors and administrator, that he or they shall and may, at all times hereafter, quietly and peaceably possess and enjoy the above granted land with every privelage, advantage and emolument thereto belonging or in anywise appertaining, and herein engages the same land to be free and clear from any encumbrances of any kind or claim, right, title, interest or demand of him, the said Stallings, his heirs, executors, administrators or assigns, or any other person or persons for him, themselves, and further the said Elisha Stallings, for himself, his heirs, administrators or assigns, will warrant and forever defend the said land against all persons whatsoever.
