Captain Benjamin Timberlake

Exec. Dept. May 1, 1838. The heirs of Benj. Timberlake are allowed L. B. for his services as a Captain in the Contl. Line. David Campbell, Gov.

Warrant 8732 for 2666-2/3 acres and warrant 8733 for 1333-1/3 acres issued 27 Nov., 1839. Recorded Book 3, p. 475.

"We, Henry, Elizabeth, Polly and Martha Timberlake of Louisa Co., Va. are the only surviving heirs of Captain Benjamin Timberlake, formerly of Louisa Co." Signed 14 Nov., 1839. Certified, John B. Shelton, J. of P.

Court of Quarterly Sessions, Louisa Co. 11th Nov., 1839. On testimony of James Michie; certified by court on motion of Robert B. Gaines, Agent for the heirs, that Capt. Timberlake died in Louisa Co. sometime between the years of 1816 and 1817, leaving five lawfully begotten children: Henry, Polly, Elizabeth, Martha, and Lucy, all of whom are now alive, except Lucy, who died since her father, intestate and without children. The rest of the children are of lawful age. True copy teste, John Hunter, Clerk.

Deposition of William Jackson to the effect that the aforementioned are the true and lawful heirs of Capt. Benj. Timberlake, and that he died intestate. Signed by William Jackson, 10 Nov., 1839.

Deposition of John B. Shelton of Louisa Co. "I lived a near neighbor of Capt. Timberlake when he died, and have lived ever since where all the heirs lived since their father's death; that the father died intestate." Signed, John B. Shelton.

The heirs appointed Robert W. Gaines of King William Co. their Atty., 14 Nov., 1839. Signed and acknd. by the aforementioned heirs of Capt. Benj. Timberlake.
