Last Will and Testament of John Fennell 1768


John Fennell’s Will
Will recorded in Book 4, pg 189 Brunswick Co., Va.
Will made in 1768 and probated in 1773

"In the name of God, Amen I, John Fennell of Brunswick County and Parrish of Meherrin, being in perfect health and memory, do make and ordain this my last will and testament in manner and form following, that is to say Impremis I give and devise unto my beloved wife Elizabeth Fennell the "Quarters" plantation and five negroes, namely Patt, Will, Amy, Jacob, and Rose for and during her natural life, and from and immediately thereafter I give and devise the said land and negroes to my son Isham Fennell, to him and his heirs forever. Item, I give and devise unto my beloved wife Elizabeth Fennell, five cows and yearlings, three horses, ten ewes, ten sows, two feather beds and furniture, and all my kitchen furniture, for and during her natural life, and from and immediately therafter, I give and devise the same unto my son Isham Fennell, to him and his heirs forever, Item, all the rest and residue of my estate in procession, remainder, and reversion of what kind and quality soever, the same is and wheresoever situation, after payment of my just debts and funeral charges, together with all the profits arising therefrom, I give and bequeath and devise unto my son Isham Fennell, to him and his heirs forever. Provided he arrives of twenty-one years, marries, otherwise I devise all my estate herefore given away, to the elder son of my son Stith Fennell, to him and his heirs forever.

And I do appoint my beloved wife Elizabeth Fennell, my son Isham Fennell, and Mr. John Davison, exectors of this my last Will and Testament, revoking all other wills, theretofore, at any time by me made. In witness whereof I have hereunto set my hand and affixed my seal, this twenty sixth day of October one thousand seven hundred and sixty eight. Signed, sealed and published, and declared in presence of George, William, and James Wall.

At a court held for Brunswick County the 22nd of Nov. 1773, this will was proved by the oathe of Geroge and William Wall, two of the witnesses thereto, and ordered to be recorded. Teste: P. Pelham, Jr. Clerk Court, State of Virginia, County of Brunswick to wit; I Willie B. Abernathy, Deputy Clerk for the Circuit Court, for the County of Brunswick, State of Virginia, so hereby certify that the above is a true copy of the will of John Fennell as recorded in Will Book 4, pg. 189, given under my hand this Willie B. Abernathy, Deputy Clerk Circuit Court for Brunswich Co. Virginia."
