"The controversy over the Makah tribal whale hunt returned
to Seattle
yesterday as opponents argued in federal appeals court that the government
improperly approved the hunt without anticipating safety and environmental
risks.
Jonathan Lovvern, attorney for U.S. Rep. Jack Metcalf,
R-Whidbey Island,
and the animal-rights groups, told the appeals panel the whale hunt
poses a
"tremendous public-safety threat to sea kayakers and whale watchers."
In addition, federal officials have refused to hand over
some 60
documents and gave their go-ahead without conducting the required
environmental assessment, Lovvern said.
Lawyers for the government and the Makahs disputed those
claims, pointing
out that the government maintains a 500-yard safety zone around the
actual

using
"emotionalism" and for "telling us something that isn't true,"
