RESOLUTION OF THE OGLALA SIOUX TRIBAL COUNCIL CALLING ON THE UNITED STATES SENATE SELECT COMMITTEE TO SUPPORT AND DEMAND THAT THE UNITED STATES SENATE JUDICIARY COMMITTEE IMMEDIATELY CONDUCT A FULL AND COMPLETE INVESTIGATION INTO THE LAW AND ORDER ACTIVITIES OF THE FEDERAL BUREAU OF INVESTIGATION (FBI) ON THE PINE RIDGE INDIAN RESERVATION FROM 1972 TO 1976. |
WHEREAS, the United States Congress, through an act of Congress, established the Pine Ridge Indian Reservation, located in the state of South Dakota - USA in 1889 and has recognized Oglala Sioux Tribal Constitution and By-Laws since 1934 (25 U.S.C., Sec. 461 et.seq.), and WHEREAS, the United States Congress has enacted the Major Crimes Act (18 U.S.C., Sec 1153) to govern all Indian reservations throughout the United States and has authorized the United States Justice Department/FBI to investigate any and all violations thereof, and WHEREAS, with respect to the Pine Ridge Indian Reservation, the U.S. Government has insidiously manufactured a climate of fear, terror, and violence; the FBI investigative conduct has grossly violated the due process rights of traditional tribal members; the FBI has engaged in outrageous and criminal acts against traditional tribal members; the June 26, 1975 shoot-out in Oglala was created by the FBI to overshadow and divert attention from the main illegal tribal land transfer of 133,000 acres to the United States Park Service, and WHEREAS, a former Assistant Special Agent in Charge (ASAC) Norman Zigrossi of the FBI in South Dakota confirmed official reports that 60 Oglala Lakota tribal members were murdered on the Pine Ridge Indian Reservation from 1972 to 1976 as uninvestigated and unresolved (video "Warrior" by Suzy Baer, 1991) and WHEREAS, today, the Oglala Lakota People are still haunted by the reign of terror and violence that was waged against the citizens of the Oglala Lakota Nation by the very same investigative agency, the FBI, and WHEREAS, on Friday, April 29, 1994, former OST President Wilbur Between Lodges, along with more than 300 leaders of federally recognized indigenous nations in the United States, met with U.S. President Bill Clinton, who had made the following statement "It is the entire government, not simply the Department of Interior, that has a trust responsibility with tribal governments and it is time the entire government recognized and honored that responsibility.", and WHEREAS, the Oglala Sioux Tribal Council, through OST Council Resolution No. 96-97, unanimously reaffirmed their support for Executive Clemency for Leonard Peltier, who has been framed and victimized by the investigative process of the FBI and the Judicial System of the U.S., now THEREFORE BE IT RESOLVED, that the Oglala Sioux Tribe calls upon the United States Senate Select Committee on Indian Affairs to request and demand that the United States Senate Judiciary Committee immediately begin Congressional oversight hearings and investigations into the law and order activites of the FBI on the Pine Ridge Indian Reservation in South Dakota from 1972-1976, and BE IT FURTHER RESOLVED, that the Senate Judicial Committee is requested o hold hearings to investigate and examine the full range of the United States Government's conduct toward traditional Oglala Lakota people on the Pine Ridge Indian Reservation, along with members of the American Indian Movement, and the "ResMurs" trial of Leonard Peltier (U.S. v. Leonard Peltier) and BE IT FURTHER RESOLVED, that the United States Senate Judiciary Commitee is hereby requested to: 1) resolve the above criminal acts against humanity; 2) review, close and remediate the chapter of gross civil rights violations waged against innocent tribal members; 3) terminate employment and benefits for all Federal law and order personnel involved in and responsible for the human rights violations of the Lakota people; and 4) to heal the wounds for all of the 60 plus family members, whose loved ones were murdered between 1972 and 1976, which still remain unsolved today. |
