PROOFS OF VIOLATION
COUNT 1 VIOLATION OF PAROLE RULE #1:
PA Hickmon with roadbook notes and face sheets can testify that Allin reported on 11/5/91. He was instructed to report on 11/19/91, but failed to report as instructed.
COUNT 2 VIOLATION OF PAROLE RULE #2:
PA Hickmon with a report from the Orlando Police Department can testify that Allin was arrested on 11/18/91. The report was faxed to the Ann Arbor Parole Office on 11/20/91. Further, Officers Browning and Arnott of the Orlando Police Department can testify that they arrested Allin for exposure of sexual organs on 11/18/91. A written statement was submitted by Allin, which is attached to the police report.
COUNT 3 VIOLATION OF PAROLE RULE #3:
Officers Browning and Arnott of the Orlando Police Department can testify that they observed Allin performing a concert naked in a Orlando Club.
NARRATIVE OF VIOLATION
Allin was required to report twice per month due to his lack of employment. He reported on 11/5/91. He was instructed to report on 11/19/91 and failed to report as instructed.
On 11/18/91, the Orlando Police observed a large crowd outside the Club Space Fish Café. Upon further investigation, it was learned that someone was performing nude in the club. The officers entered the club and observed Allin nude and rolling his head in broken glass. A co-defendant was observed dancing nude on stage. Both subjects were arrested, they were charged with Exposure of Sexual Organs. Allin was taken to Florida South Hospital and treated for several head wounds. He was released from custody.
Allin did not have written or verbal permission to leave the State of Michigan.
SUMMARY OF PAROLE
Allin paroled on 3/26/91 for a period of 21 months. His parole expires on 12/9/92. He received a $250 parole loan. He did not make payment toward the loan. Allin paroled with the following special conditions: 1. No assaultive, abusive, threatening or intimidating behavior. 2. The parolee may not possess any controlled substance or narcotic paraphernalia. 3. The parolee shall not consume intoxicants. 4. The parolee shall voluntarily seek and participate in a treatment program. 5. The parolee must submit urine specimens on a regular basis. 6. The parolee must pay the oversight fee. Allin paroled to the EMBASSY HOTEL. He was living at the YMCA when arrested. Allin reported as required. He submitted seven urines, none of the urines tested positive for intoxicants or controlled substances. He was employed as a musician. I was contacted on 10/22/91 by Investigator Peete of the Michigan State Police. He related that Allin verbally assaulted the audience and inflicted wounds on himself while performing a concert in Santa Barbara, California. I informed Allin that he could not leave the state until further notice.
Allin's risk factors are Middle Assault/Middle Property. He is on parole for Felonious Assault.
COURT INFORMATION
Allin was released by the Orlando Police Department on 11/18/91. His arraignment was scheduled for 12/9/91. As of this writing, he has not appeared in court.
EFFORTS TO LOCATE
None. I was informed that Allin was out of the state on 11/20/91. Since I did not know his address, there was no way to contact him.
RECOMMENDATION
A warrant is requested. Allin has absconded from supervision, left the state without permission, and committed another offense. He was given specific instructions not to leave the state. He disregarded those instructions and left the state of his own. By his actions, he is showing a disregard for the rules of parole. Therefore, when apprehended, a return to confinement is recommended.
