the begining of the act says its to "protect interstate
and foreign commerence ... and reduce the hazard to
persons and property arising from misuse and
unsafe or insecure storage of explosive materials"

but from reading the title of the act
    Organized Crime Control Act of 1970, Title XI
that statement is hard to beleive.

and reading thru the act it seem the main thing
the act does is get the name, address, phone number
of every person every time they buy any explosives,
along with the type and quanity of explosives bought.

but its also very easy to get high explosives the
act says that any body

    21 or over who is not a felon, a fugitive,
    drug addict or crazy

can buy all the explosives they want.

any of the same people can get a license to
make ($50), sell ($20), import ($50) and
transport explosives across state lines ($20)
for the dollar fee given.

this q/a on page 56 was interesting.

Q. I want to buy a small quanity of dynamite
from my local dealer to use on my property.
Do I need a Federal user's permit?

A. No, provided it is purchased in your
State of residence and not transported across
State Lines. A Federal user's permit is required
... to transport explosives in interstate

Q, I bought 12 sticks of dynamite to blast
stumps on my property. I have four sticks left
over. May I give them to my brother, who
does not have a Federal explosives license
or permit?

A. You may give them to your brother only if
he resides in the same State you reside. If
either you or your brother store the dynamite,
storage must be in conformity with Federal
regulations.

Q. When peson purchases explosives, does he
have to sign anything?

A. Yes. ATF Form 5400.4 will be executed by
the buyer for purchases of high and low
explosives, and blasting agents.

Q. When a person purchases explosive materials,
is the Federal Government notified?

A. No. The executed Form 5400.4 remains on the
dealers premises.

and the penalty is ($10,000 fine/ 10 years in
jail)


842 Unlawful acts

(2)knowingly to withhold information or to make
any false or fixtitious oral or written statement
or to furnish or exhibit any false, fictitious, or
misrepresented identification, intended or likely to
deceive for the purpose of obtaining explosive
materials, or a license, permit,

and you have to keep track of every explosive you
sell and who you sell it to

55.126 Explosives transaction record.

(a) A licensee or permittee shall not temporarily
or permanently distribute explosive materials to
any person, other than another licensee or permittee,
unless he records the transaction on an explosives
transaction record, (form) ATF F 5400.4
(the records have to be kept for 5 years)
