Maricopa County Libertarian Party By-laws

April 16th, 1996

Article I. Name

The name of this organization shall be

"The Maricopa County Libertarian Party", hereinafter referred to as "the Party".

Article II. Purposes

The purposes for which the Party is organized are:

A. to encourage and to co-ordinate Libertarian political activities within Maricopa County.

B. to fulfill all constitutional

requirements of the State of Arizona for a County Party within Maricopa County.

C. to fulfill all requirements of the

Arizona Libertarian Party By-laws for the

recognized County Party within Maricopa County.

D. to elect to political office Libertarian candidates running in Maricopa County.

Article III. Membership

1. a. All qualified Libertarian electors residing within Maricopa County shall be members of the Party. To be a Member of Record of the Party, a member shall pay a due of $12.00 to the Treasurer for the current calendar year. Dues are payable on the 1st day of December of the preceding year.

1. b. Any person who has been denied their right to vote by virtue of a criminal conviction for a nonviolent, victimless crime, or who is a resident alien, but otherwise meets the qualification of this section, shall be deemed a Member of Record.

2. All officers of the Party, special or standing committee members, Ward Leaders, Precinct Captains and Precinct Committeemen must be Members of Record during thir terms of office.

3. The right to vote on Party

business, elect party officers and run for County, municipal or local partisan office on the Libertarian Party ticket shall belong exclusively to

Members of Record of the Party.

Article IV. Steering Committee

1. The Steering Committee shall consist of a Chairman, 1st Vice-Chairman, 2nd Vice Chairman, Treasurer, Secretary and the appointed chairmen of all committees.

2. The Party shall elect officers at the last regularly scheduled meeting of each calendar ear, who shall take office at the close of that meeting and shall serve until the close of the next meeting at which their positions are elected.

3. 'None of the Above' shall be a valid choice in any election of officers. If 'None of the Above' receives a plurality of votes for any office, that office shall be vacant for the term; notwithstanding the provisions of Article IX.

Article V. Duties of the Officers

1. a. Upon their election and prior to the first meeting of the year, the Steering Committee shll formulate a Project Plan for the year, and shall implement such plan with the advice and consent of the Party at the first meeting of the year.

2. a. The Chairman shall preside at all meetings of the Party and of the Steering Committee, and shall attend (or appoint a representative to attend) all meetings of the State Executive Committee of the Arizona Libertarian Party, act as general spokesperson for the Party, have overall responsibility for implementing the Project Plan and the resolutions of the Party, appoint committee chairs as necessary to implement the Project Plan and ensure that the Party is in substantial compliance with the constitutional laws of the State of Arizona, the Arizona

Libertarian Party bylaws and these bylaws.

2. b. The 1st Vice-Chairman shall perform the duties of the Chairman whenever the Chairman is unable to do so, and shall assist in the implementation of the Project Plan as the chairman may direct. The 2nd Vice-Chairman shall perform the duties of the Chairman whenever the Chairman and 1st Vice-Chairman are unable to do so, and shall assist in the implementation of the Plan as the chairman may direct.

2. c. The Treasurer shall receive all monies paid to the Party, shall deposit them in such bank or banks as the Steering Committee shall designate and shall disburse said monies upon order of the Steering Committee. The Treasurer shall report the financial condition of the Party to the Party or Steering Committee when called upon to do so.

2. d. The Secretary shall be the recording officer of the Party, attend all meetings of the Party and of the Steering Committee, keeping or making provision for the keeping of such minutes and records as may be necessary.

3. a. The Steering Committee may appoint such special or standing committees as it may deem necessary to implement the Project Plan.

3. b. The Steering Committee shall establish a Precinct Committee system in accordance with the Arizona Libertarian Party Bylaws and shall, by resolution, define the duties and requirements of Ward Leaders, Precinct Captains and Precinct Committeemen. The Steering Committee shall fix ward boundaries and appoint all Precinct

Committeemen.

The Party shall neither participate nor allow its name to be used in any publicly- administered or -financed election of party officers.

3. c. The Steering Committee shall establish a Candidate Review Committee for the purpose of recruiting, qualifying and developing candidates for county, municipal and local elections and evaluating such

candidates for the Steering Committee.

The party shall neither participate nor allow its name to be used in any publicly- administered or -financed nominating election.

Article VI. Meetings

1. The Party shall meet at such times and places as prescribed by the Membership of

Record of the Party in accordance with the yearly Project Plan.

2. The Steering Committee shall meet as many times as necessary to conduct the business of the Party between regular meetings in accordance with the yearly Project Plan.

Article VII. Parliamentary Authority

1.The rules contained in the latest extant edition of Robert's Rules of Order, Newly Revised, or the Special Meeting rules adopted by the Members of Record, shall govern the Party

in all cases to which they are applicable, and in which they are not inconsistent with the laws of Arizona or these By-Laws.

Article VIII. Amendments

1. Amendments to these By-laws must be presented in writing and read aloud at any regularly scheduled meeting and shall be approved by a vote of two-thirds of those present at the next two regularly scheduled meetings.

Article IX. Vacancies

1. If a vacancy occurs in the office of Chairman, the 1st Vice-Chairman shall succeed to the office of Chairman. If a vacancy occurs in the office of 1st Vice-Chairman, the 2nd Vice-Chairman shall succeed to the office of 1st Vice-Chairman. If a vacancy occurs in the office of 2nd Vice-Chairman, Treasurer, or Secretary, the Steering Committee shall appoint a member to fill that vacancy until the next regular meeting of the Party, at which time it shall be filled by election.

2. If any elected officer fails to attend three (3) consecutive meetings, without cause, or fails to perform the duties of the office as described in Article V., the office may be declared vacant by a two-thirds vote of the Steering Committee and a two-thirds vote of the Members of Record present at any meeting.
