PAINE FAMILY OF ANCESTORS
North Carolina History:
The name Hyde Precinct was adopted after the death of Governor Edward Hyde
on September 8, 1712.
Some recent evidence has come to light that Edward Hyde served on the
Admiralty Court in West Africa, from records involving a case of piracy.
The case in question involved a Carolina ship, owned or manned by members
of the PAYNE and PUGH families of Wickham Precinct. Their ship had been
seized by a pirate group off the coast of Africa and they appealed to the
British Court for protection.
The Hyde family apparently sailed from Plymouth, England, to Virginia via
New York, as a letter of instruction, 30 Dec. 1709, to Capt. Clifton of
"The Kinsale" directed him " To give the said Mr. Hyde and his wife and
family the best accommodations the ship will afford." Also included on the
passenger list were Mr. Gale, Mrs. Sus. Winspar (?), Jon. Matthews, Wm.
Lake, Sam. Parr, James(s) Rigby, Jno. Leigh and THO. PAINE. They reached
the Albemarle area in the summer of 1710...

Located at Chickamacomico on the Pamlico Sound during the 1770's were the docks of Captain Thomas Payne's landing. It was the designated center of commerce for the area. It was once part of Currituck Co but became part of Hyde Co. NC.

In the name of God amen. I Thomas PAINE of the County of Essex and Parish
of SouthFarnham do make and ordain my last Will and Testament in manner and
form following. First I give unto my sons Thomas, John and Reubin and to my
four daughters Lettice, Frances, Catherine and Mary _____ Shillings
sterling to be equally divided amongst them in full of my Estate. Item I
give unto my loving wife Jane five pounds sixteen shillings and my bed and
furniture to her and her heirs forever. Item I give and bequeath to my two
sons William & Phillimon all the money that I have out at interest and in
the house to them and their heirs forever. Item all the money that my goods
was sold for and is now out I desire my ____ be equally divided amongst my
loving wife and my two sons William and Phillimon to them and their heires
forever. Lastly I nominate constitute and appoint my friend _______
Montague Exor. to this my last Will and Testament. In witness thereof I
have set my hand and seal this 16th Day of February 1758.

I Thomas PAINE aged Seventy one/years in good mental and bodily health, do make this my last will and improvements, via. I give and devise all that lot of land and the improvements thereon situated on the East side of coming Street,city of charleston so ca, bounded west by coming street, south by a lot owned by C.R. Brewster Eqs.r north by a lot owned by Margaret B. PAINE, to my daughter Margaret B. PAINE and her heirs.
-------I give and devise all that lot of land and the improvements thereon, situated on that corner of coming and spring streets city ofCharleston so ca bounded north by and measuring on spring street (50 )feet, west by coming street and south by lot owned by M.B. PAINE to my daughter Margaret B. PAINE her executors, administrators and assigns to be held by her in trust nevertheless for the following use and purpose, that is to say, for the sole use and benefit of my grandson Edward T. PAINE jr. until he attains the age of twenty one years, upon his attaining that age, then I give and devise the said lot of land and improvements thereon to my said grandson Edward T. PAINE jr. his heirs and assigns absolutely and forever free and discharge from all further trust.
I give and devise all that lot of land and improvements theron situated on spring street, City of charleston So Ca, bound north by and measuring on spring street, about forty one (41) feet, west by a lot devised to Edward T. PAINE jr, south by a lot owned by Margaret B. PAINE, her Executors administrators and assigns to be held by her in trust, nevertheless for the following use and purpose that is to say for the sole use and benefit of my grand son Lucius. B. Payne until he attains the age of Twenty one years upon his attainting that age, then I give and devise the said lot of land and improvements thereon to my said grandson Lucius. B. Payne his heirs and assigns abolutely and forever free and discharged from all further trust.

I give and devise all that lot of land and improvements thereon, situated on spring street city of charleston so ca, bounded north by and measuring on spring street about forty one (41 ) feet west by lot devised to Lucius B. PAINE, south by a lot owned by Margaret B. PAINE, to my daughter Margaret B. PAINE, her Executors administrators and assigns, to be held by her in trust, nevertheless for the following use and purpose, that is to say for the sole use and benefit of my grandson Arthur B. PAINE until he attains the age of twenty on years, upon his attaining that age, then I give and devise the said lot of land and improvements thereon to my said grandson Arthur B. PAINE and his heirs and assigns absolutely and forever free and discharged from all further trust.
----------I give and devise all that lot of land and improvements thereon situated on spring street city of charleston so ca, bounded north by and measuring on spring street about forty two (42) feet, west by a lot devised to Arthur B. PAINE, south by a lot owned by Margaret B. PAINE, to my daughter Margaret B. PAINE her Executors, administrators and assigns, to be held by her in trust, nevertheless for the following purpose, that is to say for the sole use and benefit of my grandson George E. PAINE untill he attains the age of twenty one years, upon his attaining that age, then I give and devise the said lot of land and improvements thereon to my grandson George E. PAINE and his heirs and assigns absolutely and forever, free and discharged from all further trust. If one or more of my grandsons should die before he attains the age of twenty one years it is my wish and will that the property devised to him or them shall be sold and the proceeds thereof be invested by said Trustee in some safe stock or otherwise for the benefit of the survivors.
--------I give and bequeath my mulatto wench named Rosetta to my daughter Margaret B. PAINE, and her heirs.
I give and bequeath the four bondsof J.H. Hilken due from him to me for money loaned him, amounting in all to One thousand four -

- hundred and twenty five dollars, to my daughter Margaret B. PAINE and her
heirs.
-----I give and bequeath to my son Edward T. PAINE and his heirs the bond I hold for one thousand dollars, due by him to me.
I give and bequeath all the stock I own or may own at my decease in the Savannah Gas Light Company to my daughter Margaret B. PAINE and her heirs.
----I give and bequeath all the stock I own or may own at my decease in the bank of charleston to my daughter Margaret B. PAINE and her heirs.
----I give and bequeath my carriage, horses, house hold and kitchen furniture, house silver, money after my debts are paid, and all property not otherwise disposed of in this will, that I may be possessed of at my decease, to my daughter Margaret B. PAINE, and her heirs. I appoint my daughter Margaret B. PAINE Executrix of this my will. I witness whereof I have hereunto set my hand and seal this first day of August in the year of our lord one thousand eight hundred and fifty seven.

In the name of God Amen, I Thomas Payne,Jr of Franklin County and State of
Georgia being in perfect health of body and perfect mind and memory, thanks be to
God, calling into mind the mortality of my body and knowing it is appointed
for all men once to die, do make and Ordain this my last Will and testament,
that is to say , principally and first of all I give and recommend my soul
into the hands of Almighty God who gave it, and as touching such worldly
estate wherewith it hath pleased God to bless me with in this life, I give
devise and dispose of in the following manner and form First I give and bequeath
to my beloved brother Nathaniel Payne one tract of land in Said county, and
lying on Dopes Creek,being the first creek that mouths in on the south Side
of the south fork of Broad river above the mulberry grove, containing one
hundred and fifty acres, the Original grant in the name of William Payne..
Secondly I give and bequeath to my beloved brother Moses Payne one track of
land, in said county and lying the south fork of Broad river being my first
tract I hold on aid south fork below Nathaniel Paynes own survey,containing
two hundred acres Thirdly I give and bequeath to my beloved brothers Champness,
Shrewsbury, Zebadiah, Poindexter and Cleveland Payne and my sister Ruth Payne
one tract of land apiece of some of my land, to be as near the value of the other
tracts, I have given to my aforesaid brothers Nathaniel & Moses Payne, and neither
of my aforesaid brothers or sisters to be visted with authority of making Sale or
conveying the aforesaid lands without the approbation, of a majority of my Executors,
here after mentioned, and the rest of my estate , both real and personal, after my
lawful debts are paid, to be disposed as follows that is to say the Negro that
Col. Benjamin Cleveland is owing me is case my beloved father should die before
the decease of my beloved mother, Yannaky Payne, said Negro during her life, and
after her dearth , to be equally divided together with the rest of my estate,
between all my beloved brothers, step brothers and sisters,and in case of my brothers
or sisters or either of their death without having any heir of his , her or
their body, that their part of my said estate shall be equally divided between
the rest of my brother and sisters and I do also hereby Constitute and Ordain
my beloved Father and my friend John Gresham, William Cawthon and Richard
White my Sole Executors of this my last will and testament in witness whereof I
have hereunto set my hand and Seal this fifteenth day of May in the year of our
Lord one thousand seven hundred and eighty six, and in the tenth year of
the,American Independency, Signed Sealed and Acknowledged in presence of us who
have in his presence & in presence of each other have hereunto Subscribed our names.
