MCPHERSON on 5 April 1821 in Roane County, Tennessee. Elender was born 27 February 1802 in Tennessee and died 21 December 1882 in Loudon County, Tennessee. Both are buried in Matlock Cemetery, Matlock Bend Road, in Loudon County, Tennessee. Chancery Court at Kingston, Roane Co, TN. 15 pages of Depositions are taken at Jesse Preston's house 2nd district, Roane Co, TN witnesses for Jesse M H Luffman, G W Fry, Lucinda Luffman, Nancy Estes, Benj Coward, Acsha Freeman Polly Vann (my 2nd gr.grandmother), Nancy Preston (my 3rd gr.grandmother), Henry Bogart Sr, Martin V. Stow, Isaac Fritts. They were trying to determine the sanity of Francis 'Fannie' Baker whether she was capable of making her on decisions. Each was cross examined and re-examined by Jesse. Question to M H Luffman: Ques: "did not Mrs Baker conclude she was bewiched" Ans: "I do not know of her complaining of being be wiched but she complained of crafts being put on her" Ques: "did Mrs Baker complain of being poisened and spells put on her and who by" Ans: "she complained Mr Matlock & Mrs Stallcuff poisning her and a variety of persons puting spells on her" Another deposition that I thought was interesting. Ques: "did you ever hear Mrs Baker say any thing about agreement between myself and her and if so what Did she say" Ans: I heard her say she went into Writings with Matlock and she Thought he would take care of her and she would rather Matlock Would take care of her as nay one Else for she had an heir by Him". **NOTE: I believe that the heir that she was referring too was Michael H Baker born after her husband's death. This Michael H Baker married Margaret Preston a daughter of Jesse Preston Sr. dec'd and Nancy Preston one of the person's giving a deposition. Jesse Preston in who's house the depositions were being given is a son of Jesse Sr. also. Nancy Preston said that she had been acquainted with mres Baker for 40 years.. .. (5)Outcome of the above hearings inquiring into the mental condition of Francis Baker a citizen of County and State, find from old age and infirmity she has but little capacity of mind wholly incapable of looking after her own interest and from the proof introduced before said Jury. She has been in this condition for 5 or more years. It it thought to be worth $170. per year the rents of which is said to have been conveyed to one Jesse Matlock during her natural live together with some other small claims. And affiavit of Rebecca Stalcup 18 Jan 1863, charging the defendant of having begotten the bastard child of which she was delivered on the 12 May 1862. Court considered that Jesse Matlock is the father of said bastard child delivered as aforesaid.. .he [Jesse Preston] excepts and prays an appeal to the term of Circuit Court. **NOTE: Why does it have Jesse Preston in these minutes? She was born about 1835 and would have been closer to Jesse Preston's age. Jesse Matlock would have been 60 + years, but still could be the father. However, in 1860 census Jesse Preston lived next door to Rebecca Stalcup, a widow with children. In the 1870 census Jesse Preston had moved away and Rebecca Stalcup had married B. Dickson, there was a child 8 years old named Lincoln, who would have been the child born 1862. Could Lincoln be the child of Jesse Preston?.... Attorney's behalf of parties, to meet next term. Pg 372, March 6 term. Could not make it to court; Pg 397, Her child born 12 May 1862, Jesse Matlock was found to be the father. Had to pay maintenance of $40. for 1st year, $30. for 2nd year, $20. for 3rd year. To appear again in court; Pg 526, 4 Dec 1865 came to court and acknowledged indebtness of $250. till next session; Pg 542, Rebecca and her attorney appeared in court 2 Jan 1866; Pg 544, came to court and acknowledged their indebitness for $500; Pg 560, 6 Feb 1866, he was charged maintance for said child...
