PSEUDO-RETROGRADE EXTRAPOLATION:
THE GOVERNMENT'S SECRET WEAPON

Retrograde extrapolation is the term given to the assumption that blood-alcohol levels always drop after a citizen stops drinking. The presumed level of blood-alcohol, at the time of the traffic stop or collision, is theoretically equal to the blood-alcohol test result plus approximately 0.015% for every hour that had passed between the time of the incident to the time of the BAC test. Other experts recommended 0.20% BAC drop per hour, which is even more damaging to a citizen (in this example). This is to allow time for the liver to metabolize the alcohol. One legal textbook on DWI law points out that: "One should not lose sight of the requirement that the prohibition is for driving or being in physical control 'while 'under the influence' of an intoxicant or prohibited drug."

For example, at a test score of 0.14% BAC, three hours after a traffic stop, would equal a presumed blood-alcohol level of 0.14% + 0.015% + 0.015% + 0.015% = 0.185% BAC. This theoretical score is 0.085% above the per se legal limit, resulting in automatic loss of a driver's license for one year, and also transfers the presumption of innocence from the government onto the citizen. If a fatal traffic accident had occured, regardless of who was primarily at fault, a citizen would face a ten year prison sentence for murder. (If drug paraphenalia had also been found, the citizen might face a life sentence, even without drug testing.) The only score that matters to a court of law is the citizen's blood-alcohol level at the time of the incident, in this case that level is presumed by the government to be 0.185% BAC.

The above example assumes that the citizen is "post absorptive," which means that it is assumed that the person's body has already absorbed (digested) all of the alcohol that had been consumed. It is also taken for granted that the citizen had not eaten any food whatsoever, within several hours of drinking the alcoholic beverage(s).

However, if the citizen had not yet digested all of the alcohol consumed, or had eaten a meal, the government's extrapolation of his blood-alcohol level could be over-estimated by a factor of ten. This government error of 1,000% does not even include possible errors in the mechanical testing equipment or its machine operation. Other factors that can delay alchol absorbtion are severe crash trauma, emotional disturbance, some drugs, individual physiology and the person's activity level.

Taking a look at the chart published in the Massachusettes Law Review reveals how this mistake is made. This chart reveals the results of a laboratory test where a person's blood-alcohol level was tested every thirty minutes, proving exactly what the score was in reality at a given time. Since the alcohol is still being absorbed, the person's blood-alcohol level is still rising for the next three hours, after he had finished drinking. It is not falling, as would have been presumed by the government. Instead of a score of 0.185% BAC, the citizen's score had been 0.020% BAC, at the time he had ceased drinking, nearly ten times lower. With the traffic accident occurring thirty minutes after leaving the restaurant, this hypothetical citizen's blood-alcohol level was only 0.040% BAC at that time, not 0.180% BAC. This illustrates a huge miscalculation that would typically be made by the government.

To police and other government officials who deal with the profits taken from millions of citizens for annual alcohol Prohibition arrests, knowledge of how retrograde extrapolation really works means billions of more dollars they can seize from the citizenry. The government has known this information for decades. "Psuedo-retrograde extrapolation" is another of the government's secret weapons it uses against the ignorant public.

In reality, responsible drinkers do NOT drink 5 drinks INSTANTLY. In reality, responsible drinkers digest alcohol almost as fast as they drink it. This results in a very low blood-alcohol level. This low level does NOT impair responsible drivers, as proven by numerous medical studies.
