“Early Greene Co, TN Wills” No 53 Philip Babb Senr Monday 25th January 1813 Will proven by affirmation of John Coulson and Thomas McAmis and oath of Robert Daniel the subscribing Witnesses and ordered to be recorded and Robert Antrim and Jesse Davis qualified as Executors (Min 7, pg 79) Will: To all whom these presents may come or be made known Know ye that I Phillip Babb Senior of Greene County and state of Tenesee being weak in boddy but of sound and perfect memory and calling to mind the uncertainty of time, Do make, ordain and constitute this my last Will and Testament in form and manner following Viz: 1st It is my will that my just debts and funeral expenses be paid by Executors hereafter named out of my personal Estate 2nd I give and bequeath unto each of my children, one dollar over and above what the have had bestowed on them heretofore to be paid by executors out of my personal property 3rd It is my will that the residue and remainder of my personal property that may be at my discease be equally divided between my step son Robert Antrim and my step soninlaw Jesse Davis who for good causes I do hereby apoint my lawful Executors to see that this my will is Duly Executed and do hereby revoke and Disanull all former will or wills by one made and above this and this only to be my Last will and testament in testimony where of I have hereunto set my Mark to & seal and ~ ~ ~ ~ ~ ~ “Early Greene Co, TN Wills” No 147 Seth Babb, decd 5 Sep 1836, Min 18, pg 229 The execution of the last will and Testament of Seth Babb, decd was proven in open court by the oath of Abner Babb and Hugh Carter Jr the subscribing witnesses thereto and ordered to be recorded and is as follows – To all whom it may concern - In the name of God Amen Whereas I Seth Babb of the County of Greene and state of Tennessee being weak in body but of sound and perfect memory and understanding Thanks be to the Almight for the mercies and cauling to mind that it is apointed for all men anser to die I do make and constitute this to be my last will and Testament and as to charg my worldly Estate I give and dicmise and dispose of in the following manner to witt – That my funeral charges and just debts be paid out of my moreable Estate – Article first: I give and bequeath unto my beloved wife Mary Babb two cows, one horse of common rate also the mansion house with the adjoining buildings and a good garding One fouth of the orchard and meadow also one fourth of all the profits of the said plantation I now live on the liberty of one mare of said barn and one stables one fourth of the profits of the sugar trees – also two good beds and furniture also a sufficient assortment of house and kitchen furniture – also the clock during her naturel life – Art 2 I give and bequeath to my son Hiram Babb in addition to what he has received of my Estate my Janes Suit of clothes – also to my other two son Err Babb & Seth Babb my farming tools and maccanacle tools to be divided equally between them it is further understood tht the plantation I now live on has been heretofore deeded to the said Err & Seth & that Hiram has had his portion of Land deeded to him theretofore - Art 3 My daughters, Ruth, Mary Hulda and Rhoda in addition to what they have received in portion, I will and bequeath to each of the above named Daughters one dollar each – Art 4th I give and bequeath to my Daughter Nancy Lowe Babb in addition to what she has had one cow and calf one chest & one flax whell, also at the death of her mother Mary Babb, forty Dollar if there should be that much remaining – Art 5 I give and bequeath to my gran daughter Martha Babb, daughter of Rhoda Waker formerly Rhoda Babb the sum of Twenty seven Dolears when she arrives to the age of Twenty one years of age – And lastly I hereby appoint my two sons Err Babb and Seth Babb Jr my Sole Executors of this my last Will and Testament and hereby revoking all others and former Wills by me made – In witness whereof I and State of Tennessee Do make and publish this as my last will and Testament hereby revoking and making void all other Wills made by me heretofore at any time – First I direct that my funeral expenses and all my debts be paid as soon after my death as possible out of any money that I may did possesed of or may first come into the hands of my Executors Secondly I give and bequeath to my beloved wife Nancy Babb a lot of land to include the orchard and barn and dwelling house Beginning at the spring running a north west direction so as to include the orchard running with the orchard fence where it now stands and then across the waggon road, so as to include the stabile on the south side of said road thence to the beginning at the spring This boundary is to be for the sole use of the aforesaid Nancy Babb during her natural lifetime or widdowhood and for the support of the aforesaid Nancy Babb, and I direct there be laid off out of my estate a reasonable support paid to her by their honest and discreet men chosen by the County Court of Greene County to make such allowance as shall seem reasonable to them and I also direct that all my real estate shall all be held responsabill to all intents and purposes for to secure to the said Nancy Babb a comfortable living, and as to my pershabill property I direct that the said Nancy Babb have two cows of her own chosing from my stock of cattell and four head of hogs four head of sheep and all the household and kitchen furniture beds and bedding during her natturale lifetime or widdowhood Thirdly I give and bequeath to my beloved four sons, namely William Babb, Abner & Phillip and Samuel Babb the land that I die seised and possessed of either by deed or entry or in any way belong to me in said County of Greene with all the improvement and heredatraments thereunto belonging to be equally divided between the aforesaid sons William, Abner, Philip, and Samuel immediately after the death of my wife Nancy and myself to be an inheritance to them and their heirs forever Fourthly I direct that soon after my death that all the surplus property of every description that is not heretofore named shall be equally divided between my daughters Namely, Rebecca, Elizabeth, Rhody and Anna Meriah to be divided equal to be divided as my Executors may think propper either by sale or valuation Fifthly and lastly I do of Greene county in district No 9 and State of Tennessee being in good health and sound mind and disposing memory for which I thank GOD and calling to mind the uncertanty of human life; and being desirous to dispose of all such worldly substance as it hath pleased GOD to bless me with I do make and publish this as my last Will and Testament, hereby revoking and making void all other wills by me at any time made First, I direct that my General expences and all of my just debts be paid as soon after my death as possible out of any money that I may dispossed of or may first come into the hands of my Executor Second, I desire after the payment of my debts and funeral expences; that all of estate both real and personal be equally divided among my lawful children I give the same to my
