To the worshipful Court of Wythe County in Chancery sitting:

Humbly complaining ______ unto your Worship, Your Orator, Lewis Grubb.  That a certain Francis Grubb of said county, lately departed this life intestate, and at the time of his death ____ seized and possessed of a tract of land on said County of about three hundred acres.  The said Francis Grubb left Mary his widow surving, but no children – He left your Orator who was his brother and a sister who is now Susan Cline, her husband being dead & who also survived him, and also the desendants of brothers and sisters who died before him and who are the following… to wit, Jacob Grubb, William Grubb, Curtis Grubb, & Esther Grubb children of Jacob Grubb Sen decd who was a brother of the Intestate also Ephraim Patton, Betsy Patton who married Jacob Wampler, Esther Patton who married        Bell; & Polly Patton.  The said Ephraim, Betsey, Esther & Polly being children of Catharine who was also a daughter of the said Jacob Grubb Senr & who married Henry Patton, the said Catharine having departed this life,  before her father leaving the aforesaid children and her husband surviving her – John Grubb who was another brother of the said Francis, died before him leaving the following children, to wit, Henry, John, Archibald, Jackson, Elizabeth, Ann who married Michael Walters, and Polly who married Joseph Colvin & who has departed this life leaving the following children, to with, Joseph, Jackson, Catharine who married John Daugherty, Angeline who married                            Shinal?, and             who married Leonard Etter – Isaac Grubb who was another brother of the said Francis, also died before him, leaving the following children, to wit, John Henry, Peter, Joseph, Isaac, Nicholas, Mima who married George Cline, (her husband being dead) Elizabeth who married Lewis Kegley, and Mary who married Michael Kinser – Peggy who was also a sister of the said Francis having married Jacob Hilton, died in the lifetime of the said Francis, leaving the following children to wit, Joseph, Jacob, Samuel, Polly who married Solomon Smith, Peggy who married Morgan Miller, Elizabeth who married Jacob Jonas, and Turly Hilton.  The aforesaid persons are the heirs at law of the said Francis Grubb decd, and entitled to the real estate aforesaid.  It will be perceived  that your Orator is entitled to one sixth of said tract of land, Susan Cline to one sixth & the descendants of Jacob, John & Isaac Grubb decd to the shares (of their resp____tion)[marked thru] which they if living would take which would have been to the said Jacob, John & Isaac one sixth each, and the descendants of Peggy Hilton decd to one sixth, the siad descendants taking per stripes – Your Orator is entitled and claims to have partition of the said tract of land, and to that and he prays that the widow and heirs at law aforesaid be made parties defandants to this bill and answer The same on oath – That partition of said tract according to quality and quantity be deceied, and commissions be appointed to make said partition and assigns dower to the widow – and that such further and general relief in the premises be granted heirs as the equity belong, and his case shall re____ – May it please your worship to grant the commonwealth suit of ____devided &c
