Monastario has a second plan in mind even as he has the search for Don nacho continue.  He makes romantic advances toward Elena Torres.  He implies that if she will marry him, he might be able to save her father from the gallows.  Elena, desperate to save her father, considers his proposal.  However before she can answer, Diego comes out onto the patio where she and Monastario are.  He has a guitar and serenades her, much to Monastario's chagrin.  The moment is lost, and they return to the house.  Monastario's proposal remains unanswered.
Diego puts a crimp in Monastario's plan to become the wealthiest man in California by taking over the Torres rancho and marrying the lovely Elena.
During a search of the upstairs rooms, Diego distracts Monastario when he notices that Nacho Torres is not well hidden.  Diego invites Capitan Monastario to watch the sunset with him.  Annoyed by what he considers foolish romanticism, Monastario brushes Diego away and goes back down stairs.
Diego tells Senor Torres and Elena that the only way to get Torres safely out of the house would be in the Commandante's own uniform.  As he hopes, Torres overhears Diego.  A few moments later Diego, downstairs with Monastario once more, says that he hears a sound coming from the basement.  The ploy works, and while Monastario is intent on listening, Bernardo drops a flowerpot on his head and knocks him unconscious.  Diego carries Monastario ustairs, lays him on a bed, and leaves.
Nacho Torres escapes with the help of Diego and Bernardo.
Nacho Torres and his wife remove Monastario's uniform, and Torres puts it on.  Leaving Monastario tied to the bed, Torres and his family go out the front door and into Monastario's waiting carriage.  Diego remains behind.  When the soldiers realize that it is not their commandante in the carriage, Zorro's appearance allows Nacho Torres to escape alone.
When Monastario is released, he is convinced that Diego de la Vega has something to do with Torres' escape.  He is perplexed when he finds Diego and Bernardo tied to the staircase in the basement.

Diego's plan backfires.  Enraged over having been outwitted by Zorro and Nacho Torres, Monastario orders the Torres women arrested.  While he intends no real harm to the women, Monastario thinks that either he will use them as bait to capture Zorro, or Nacho Torres will return of his own accord.  He wants them to sign a statment declaring Nacho Torres a traitor.  When the women refuse.  Monastario withholds food and water.  He is determined to bend them to his will.
The Torres women are carted off to jail to be used by the dastardly commandante to force Sr. Torres from hiding.
Diego visits the women.  Outraged at their treatment, he confronts the Commandante, but to no avail.  Monastario is determined his plan will work.  Diego is concerned that the vaquero, Benito, will do something foolish and orders him to stay away from the cuartel.  Benito doesn't listen.  Dressed as Zorro, he sneaks into the cuartel to rescue his ladylove.  Instead, Benito is captured by Monastario.  He is to be hanged without a trial.
