Fight for Free Speech Online Headed to Supreme Court!

SUPREME COURT HEARS ORAL ARGUMENTS IN THE CDA CASE

On Wednesday March 19th, the US Supreme Court heard oral arguments in the challenge to the Communications Decency Act, a case which will determine the future of the Internet and the fate of the First Amendment in the Information Age. A decision is expected in late June or early July.

Bruce Ennis, CIEC lead attorney, who argued the case on behalf of both the ACLU and CIEC Plaintiffs, discussed the case and the oral arguments at a special online event on March 19th. Audio transcripts are available online here...

Judith Krug of the American Library Association, lead plaintiff in the case, noted that the Justices ''paid special attention to the threat that the CDA would pose to libraries around the country seeking to use the Internet to provide greater public access to information.''

In questions to both Mr. Ennis and the Justice Department attorney defending the statute, the Justices probed the effectiveness of this statute as compared to software tools which empower parents to filter out inappropriate Internet sites whenever their children surf the web.

With a decision expected in late spring or early summer, coalition members expect that the issue will be back before the US Congress shortly.

THE NEWSPAPER DECENCY ACT?

In numerous, often pointed questions throughout the hearing, the Judges pressed the government on whether the Internet is a unique communications technology distinct from traditional broadcast mass media.
At one point Judge Dalzell, holding up a copy of the Philadelphia Inquirer, noted that the previous day's issue contained a graphic image of a man being shot on the front page above the fold. Dalzell said that his 10 year old son had seen this picture while looking for the scores from the previous day's Philadelphia Phillies game, Dalzell was concerned that the Image was not appropriate for a young child to view. Dalzell asked Coppolino if Congress were to pass a 'Newspaper Decency Act' requiring that Newspapers publish graphic images below the fold {so that minors do not inadvertently see them} would the law be unconstitutional.
When Coppolino agreed that the hypothetical Newspaper Decency Act would indeed be unconstitutional, Dalzell asked if Congress similarly has the power to control the Internet.


Sen. Exon Ducks Internet Inquiries

From 'interactive week'...More than a year after he introduced the law that bans indecency on the Internet, neither Sen. James Exon nor his aides are offering much help to Internet access companies trying to figure out how to comply with the Communications Decency Act.

Is this the Net we want in our future? Under the Communications Decency Act, signed into law by President Clinton with a flourish of his digital pen on 8 February, this is the Net we have.

Now that the Communications Decency Act has passed, we urge all people wishing to use electronic communications, but forced to limit their language and thus risk confusion, to consider using the following list of substitute words, which we feel the Senators involved will be reluctant to ban or censor...

Byrd- Noun- The posterior or hinder parts, specifically the anus.
Coats- Noun- Excrement, or as a verb to excrete.
Exon- Verb- To copulate with, the act of copulation.
Gorton- Noun- The female genitals, or specifically the vagina.
Gramm- Verb- To achieve orgasm. Also colloquially used as a noun.
Heflin- Noun- The female secondary sexual characteristics.
Helms- Noun- The male phallus.

An example of this usage might be as follows...

'Exon me !', she cried, as I licked her hot wet Gorton. She writhed under my teasing tongue as her Gramm washed over her, her juices pouring out. I moved up to suck and nibble her Heflins, only to have her clutch my Byrd, and drive my aching Helms into her waiting Gorton. 'Coats !', she said, 'We're being quoted in a political text !'

As Ira Glasser, executive director of the American Civil Liberties Union, has noted, 'This law restructures the entire telecommunications industry and places the free speech and privacy rights of all Internet users in permanent jeopardy. For a Congress that says it wants to get big government out of people's lives, this law represents the most extreme hypocrisy.'


There's More to Tell, What Senator Exon Did to us...

What Exon didn't tell you, however, is that the bill has slapped criminal liabilities on all Internet service providers, commercial online services, bulletin board systems and even electronic mail providers whenever their services are used to transmit any material that's considered "obscene, lewd, lascivious, filthy, or indecent." Oh yeah, the person actually responsible for sending the message gets hammered as well, with up to US$100,000 in fines and two years behind bars.

Friends, things are changing. Amongst other things, the date of the march has been changed from June 30th until {tentatively} Sunday, September 29th. Why ??? Organizing the march has been a LOT harder than we had anticipated. The Court challenge against the CD A is proceeding far faster and far better than we had hoped. And there are other Net Issues ahead... the Crypto Bill is our next challenge.
